After review of the proposed findings and conclusions submitted by the parties pursuant to Sec. 111.68, the hearing officer will make his recommended decision in the case and certify the entire record to the Secretary of Homeland Security, or his designee. The hearing officer's recommended decision must conform to the requirements of 5 U.S.C. 557.
