(a) Under instructions issued by the Department, the Governor, or the highest government official, must review the State Plan and submit an update to the State Plan to the Secretary for consideration and approval not less often than every two years. OAA Sec. 503(a)(1). States are encouraged to review their State Plan more frequently than every two years, however, and make modifications as circumstances warrant, under Sec. 641.345.

(b) Before development of the update to the State Plan, the Governor, or the highest government official, must seek the advice and recommendations of the individuals and organizations identified in Sec. 641.315 about what, if any, changes are needed, and must publish the State Plan, showing the changes, for public comment. OAA Sec. section 503(a)(2), 503(a)(3).
