To incidentally take marine mammals pursuant to these regulations, the U.S. Citizen (as defined by Sec. 216.103 of this chapter) conducting the activity identified in Sec. 218.120(c) (i.e., the Navy) must apply for and obtain either an initial Letter of Authorization in accordance with Sec. 218.127 or a renewal under Sec. 218.128.
