Notwithstanding takings contemplated in Sec. 218.12 and authorized by an LOA issued under Sec. 216.106 of this chapter and Sec. 218.17, no person in connection with the activities described in Sec. 218.10 may:
(a) Take any marine mammal not specified in Sec. 218.12(c);
(b) Take any marine mammal specified in Sec. 218.12(c) other than by incidental take as specified in Sec. 218.12(c);
(c) Take a marine mammal specified in Sec. 218.12(c) if a finding is made that such taking is having more than a negligible impact on the species or stocks of such marine mammal; or
(d) Violate, or fail to comply with, the terms, conditions, and requirements of these regulations or an LOA issued under Sec. 216.106 of this chapter and Sec. 218.17.
