To incidentally take marine mammals pursuant to these regulations, the U.S. citizen (as defined at Sec. 216.103 of this chapter) conducting the activities identified in Sec. 218.40 must apply for and obtain either an initial Letter of Authorization in accordance with Sec. 216.106 of this chapter and Sec. 218.47 or a renewal under Sec. 218.48.
