(a) The requirements of this subpart apply to owners or operators of reclamation and intermediate facilities managing hazardous secondary materials excluded under 40 CFR Sec. 261.4(a)(24), except as provided otherwise in this section.
(b) States and the Federal government are exempt from the financial assurance requirements of this subpart.
