To incidentally take marine mammals pursuant to the regulations in this subpart, the U.S. citizen (as defined by Sec. 216.106 of this chapter) conducting the activity identified in Sec. 218.90(c) (the U.S. Navy) must apply for and obtain either an initial LOA in accordance with Sec. 218.97 or a renewal under Sec. 218.98.
